General Terms and Conditions

These General Terms and Conditions govern the purchase of fine art prints and wall art from the "Galería Auraris" online shop of Iris & Martin C. Heyn. All products are manufactured using a print-on-demand process only after the order has been received.

§ 1 Scope

These General Terms and Conditions apply to all contracts between the Seller and customers (consumers and traders) concluded through the online shop under the domain galeria-auraris.com or the respective main domain.

Any differing terms and conditions of the customer shall not be recognised unless the Seller expressly agrees to their application in writing.


§ 2 Conclusion of the Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.

(2) By clicking “Buy now” / “Order with obligation to pay”, the customer submits a binding offer to purchase.

(3) The Seller confirms receipt of the order by email. This confirmation of receipt does not yet constitute acceptance of the offer.

(4) The purchase contract is concluded as soon as the order is accepted by the Seller or forwarded to the production partner for processing. The customer will be informed of the conclusion of the contract by email. The statutory right of withdrawal of consumers remains unaffected.


§ 3 Prices and Payment Terms

(1) All prices stated are final prices in euros (€). The Seller applies the small-business scheme pursuant to § 19 of the German Value Added Tax Act (UStG). The transactions are therefore exempt from VAT pursuant to § 19 UStG.

(2) Payment can be made by:

  • Shopify Payments (credit card, debit card, and, where applicable, other methods)
  • PayPal

(3) The invoice amount is due immediately upon completion of the order.


§ 4 Delivery and Shipping

(1) The Seller delivers to Germany, Austria, Switzerland and all Member States of the European Union.

(2) The delivery time is generally 7–14 working days from receipt of the order, as all products are manufactured using a print-on-demand process only after the order has been received. Any differing delivery times will be stated on the respective product page.

(3) Production and shipping are carried out by an external production partner (Gelato). Shipping is carried out by a commonly used parcel delivery service.

(4) Deliveries to Switzerland may be subject to additional customs duties, taxes and fees, which shall be borne by the customer.

(5) Partial deliveries are permitted provided that this is reasonable for the customer.


§ 5 Retention of Title

The delivered goods remain the property of the Seller until payment has been made in full.


§ 6 Right of Withdrawal

(1) Consumers are generally entitled to the statutory right of withdrawal. Details are set out in the information on the right of withdrawal provided in the online shop.

(2) The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the production of which an individual choice or decision by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.

(3) Traders do not have a statutory right of withdrawal.


§ 7 Statutory Rights in Respect of Defects and Liability for Defects

(1) The statutory rights in respect of defects apply.

(2) In the event of transport damage or defects in the delivered product (e.g. printing errors or damage), the Seller asks the customer to contact the Seller by email at info@galeria-auraris.com as soon as reasonably possible, if possible enclosing photographs of the defect or damage. The customer's statutory rights in respect of defects remain unaffected.

(3) The appearance of an artwork on a screen may differ from the actual colour reproduction of the printed product. In particular, the quality, technology, brightness, contrast, colour profile and individual settings of the screen used may affect the colours perceived. Minor technically induced production variations may also occur. Statutory rights in respect of defects remain unaffected.


§ 8 Copyright and Rights of Use

(1) All artworks and designs offered in the shop are works by Iris Heyn protected by copyright.

(2) By purchasing a product, the customer acquires ownership of the physical product. No copyright or rights of use in the artworks depicted are transferred.

(3) Reproduction, distribution, making the artworks available to the public or any other use of the artworks – including in digital form – is prohibited without the Seller's express written permission.


§ 9 Limitation of Liability

(1) The Seller shall be liable without limitation for damage arising from injury to life, limb or health resulting from an intentional or negligent breach of duty by the Seller, its legal representatives or persons employed in the performance of its obligations. The same applies to other damage resulting from an intentional or grossly negligent breach of duty by the Seller, its legal representatives or persons employed in the performance of its obligations.

(2) In the event of a slightly negligent breach of essential contractual obligations, the Seller shall be liable only for the typical and foreseeable damage arising from the contract. Essential contractual obligations are those obligations whose fulfilment is necessary for the proper performance of the contract and on whose observance the customer may ordinarily rely.

(3) Otherwise, liability for damage caused by slight negligence is excluded.

(4) Mandatory statutory provisions on liability remain unaffected.


§ 10 Data Protection

Personal data is collected and processed in accordance with the separate Privacy Policy available in the shop.


§ 11 Consumer Dispute Resolution

The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer dispute resolution body.


§ 12 Governing Law and Jurisdiction

(1) All legal relationships between the Seller and the customer shall be governed by the law of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.

(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, Sindelfingen shall be the place of jurisdiction for all disputes arising from the contractual relationship. Otherwise, the statutory rules on jurisdiction shall apply.


§ 13 Severability

If individual provisions of these General Terms and Conditions are or become invalid, the validity of the remaining provisions shall remain unaffected.
